By creating an account, signing in, or otherwise using the Services you agree to these Terms of Service. If you are accepting on behalf of an organization, you represent that you have the authority to bind that organization.
1. Your account
You are responsible for keeping your credentials secure and for all activity that occurs under your workspace. Notify us immediately of any unauthorized use. Workspace owners are accountable for the conduct of their team members on the platform.
2. Acceptable use
You agree not to:
- Reverse-engineer, decompile, or otherwise attempt to derive source code from the Services.
- Resell, sublicense, or white-label the Services without a written commercial agreement with BaristaGrid.
- Upload content that is unlawful, infringing, deceptive, or that violates the privacy or labor rights of others.
- Probe, scan, or test the vulnerability of the Services without prior written consent.
- Use the Services to transmit malware, spam, or otherwise interfere with normal platform operation.
3. Subscriptions & billing
Paid plans renew automatically until canceled from the billing settings. Fees are billed in advance and are non-refundable except where required by law. We may adjust pricing with at least 30 days' notice; changes apply at your next renewal cycle.
4. Customer data
You retain all rights to the data you submit ("Customer Data"). You grant BaristaGrid a worldwide, royalty-free license to host, process, transmit, and display Customer Data solely as needed to deliver and improve the Services. We do not use Customer Data to train third-party AI models.
5. Service availability
We work continuously to keep the Services available, but we do not guarantee uninterrupted access. Maintenance windows and incident reports are published on our status page. Premium plans include a written uptime commitment; see your order form for details.
6. Termination
You may close your account at any time. We may suspend or terminate access for breach of these Terms, non-payment, or conduct that creates legal or operational risk for the platform. Upon termination, Customer Data is available for export for 30 days before being permanently deleted.
7. Disclaimers & liability
The Services are provided "as is" without warranties of any kind, except as expressly stated. To the maximum extent permitted by law, BaristaGrid's total liability for any claim arising from these Terms is limited to the fees you paid in the twelve months preceding the claim.
8. Governing law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. Any dispute will be resolved exclusively in the state or federal courts located in Wilmington, Delaware.
